1. Introduction Welcome to Ivy Digital. These Terms & Conditions govern your use of our services and website. By accessing or using our services, you agree to comply with these terms. If you do not agree, please refrain from using our services.

2. Services Provided Ivy Digital offers digital marketing solutions, including but not limited to SEO, Social Media Marketing, Website Development, PPC Advertising, and Competitor Analysis. The scope of work for each service is outlined in a separate service agreement or proposal.

2.1 Service Modifications We reserve the right to modify, suspend, or discontinue any service at our discretion without prior notice. Clients will be informed in case of significant changes affecting their services.

3. User Responsibilities By using Ivy Digital’s services, you agree to:

  • Provide accurate and updated business information for the execution of services.

  • Comply with all applicable laws and regulations regarding digital marketing practices.

  • Ensure payments are made as per agreed terms to avoid service disruptions.

3.1 Prohibited Activities Clients must not:

  • Engage in any unlawful, fraudulent, or unethical activities using our services.

  • Use our services for spam, misleading advertising, or unauthorized data collection.

  • Attempt to reverse engineer or replicate Ivy Digital’s proprietary methods or tools.

4. Payment & Billing Payments for services must be made as per the agreed terms in the contract or invoice.

Credit Card & Debit Card Payments

At Ivy Digital, we prioritize the security and convenience of your online transactions. To facilitate seamless payments, we utilize Nomod, a UAE-registered payment platform renowned for its robust security measures and versatile payment options.

Through Nomod, you can confidently make payments using Debit cards, Credit cards, and popular “buy now, pay later” services like Tabby and Tamara. All transactions are encrypted to ensure your sensitive information remains protected. Importantly, Ivy Digital does not store any of your payment details, safeguarding your privacy throughout the payment process.

Currently a processing fee of 3% per transaction is levied on Nomod transactions & additionally, a standard VAT of 5% is applied to all transactions as per UAE regulations. By making a payment through these gateways, you acknowledge and agree to these charges. 

Please note, transaction fees and taxes are non-refundable under any circumstances. 

Once work has commenced or services have been initiated, no refunds of any amounts paid will be provided. All payments are securely processed using encrypted methods for your safety and reliability. For questions or assistance, please contact us directly.

4.1 Late Payments

  • Late payments may result in service suspension until outstanding balances are cleared.

  • A late fee of [insert percentage] may be applied to overdue invoices.

4.2 Refund Policy Refunds are subject to Ivy Digital’s Return & Refund Policy.

5. Confidentiality & Data Protection Both parties agree to keep confidential information secure and not disclose it to unauthorized third parties.

5.1 Client Data Usage We may use collected data solely for service improvement and business development purposes, in compliance with applicable data protection laws.

5.2 Third-Party Services We may use third-party tools or platforms to enhance our services. Ivy Digital is not responsible for the privacy policies of third-party services used.

6. Intellectual Property All content, trademarks, and materials developed by Ivy Digital remain our intellectual property unless otherwise agreed upon in writing.

6.1 Client Ownership Clients retain ownership of all original content and data provided to Ivy Digital for service execution.

7. Limitation of Liability Ivy Digital is not liable for indirect, incidental, or consequential damages arising from the use of our services.

7.1 Service Performance While we strive to deliver optimal results, we do not guarantee specific outcomes or rankings due to factors beyond our control.

8. Termination of Services Either party may terminate services with prior written notice as per the terms outlined in the service agreement.

8.1 Grounds for Termination We reserve the right to terminate services immediately if a client engages in fraudulent or unethical activities or breaches these terms.

9. Dispute Resolution Any disputes arising from these terms will be handled through good-faith negotiations. If unresolved, disputes will be settled in accordance with the governing laws of the UAE.
